1. About these terms
1.1 These terms apply to your use of thesaathfoundation.com and any Saath Foundation app or service that links to them (the "Site"). The Site is run by The Saath Foundation, a public charitable trust registered in Delhi on 20 December 2016, PAN AASTS4419F, registered address 754, Guru Apartments, Sector 14, Rohini, Delhi 110085 ("Saath Foundation", "we").
1.2 By using the Site you agree to these terms. Other policies also apply and form part of these terms:
- Privacy Policy (
/en/policies/privacy) - Cookie Policy (
/en/policies/cookies) - Donor Terms (
/en/policies/donor-terms), if you give - Refund & Cancellation Policy (
/en/policies/refunds) - Child Protection Policy (
/en/policies/child-protection) - Volunteer Code of Conduct, if you volunteer
- Visit Policy and Visitor Code of Conduct, if you take part in Meet Your Saathi
- Grievance Redressal Policy (
/en/policies/grievance)
If these terms conflict with a more specific policy, the more specific policy wins. The Child Protection Policy always wins where a child's safety is concerned.
2. Who may use the Site
2.1 Anyone may browse the public pages.
2.2 To create an account, give, volunteer, request a visit, run a fundraiser or message a child through the moderated channel, you must be 18 or over and able to enter a binding agreement under Indian law. We ask you to confirm this when you give or open an account. If we find that a gift was made by someone under 18, we may return it to the parent or guardian.
2.3 A child may use only the parts of the Site built for children (for example the online classroom), only with the verifiable consent of a parent or lawful guardian, and only as the Child Protection Policy allows.
2.4 We may refuse, suspend or close any account to protect a child, to comply with law, or for breach of these terms.
3. Your account
3.1 Give accurate details and keep them up to date. Keep your password and devices secure. Tell us at once at help@thesaathfoundation.com if you think someone else has used your account.
3.2 One person, one account. Company and CSR accounts must be opened by an authorised representative.
3.3 Some features need extra identity checks (for example the Rupee Trail's vendor detail and Meet Your Saathi). We decide whether a check is passed.
4. Acceptable use
You must not:
- (a) try to identify, locate, contact or meet any child, family, partner home or school outside Saath Foundation's supervised processes;
- (b) copy, screenshot, download, share or publish any child's profile, photo, story, update or Rupee Trail detail, except as the Donor Terms allow;
- (c) post or send anything abusive, sexual, discriminatory, threatening, misleading or unlawful, or anything that asks a child or family for contact details, money or a meeting;
- (d) pretend to be someone else, or misstate your citizenship, source of funds or identity;
- (e) use the Site to launder money, evade tax, or route foreign contribution outside the FCRA route;
- (f) scrape, crawl, data-mine or bulk-download the Site, or use it to train AI models, without our written permission;
- (g) probe, attack or interfere with the Site's security, or upload malware;
- (h) use the Site to promote a business, political party, religion or another fundraiser, except through features we provide for that purpose.
Breaking (a), (b) or (c) is also a breach of the Child Protection Policy. We will suspend the account and may report it to the police or a Child Welfare Committee.
5. Content you give us
5.1 You keep the rights in messages, fundraiser text and photos you upload ("your content").
5.2 You give Saath Foundation a free, non-exclusive licence to host, moderate, display and share your content for running the Site and our programs, and for publicity with your permission.
5.3 Messages to a child go through a moderated channel. Staff read every message before it reaches a child and may edit, hold or reject it. Messages must not contain contact details, links, requests to meet, promises of money or gifts outside Saath Foundation, or questions about the child's past, family, health, caste, religion or location.
5.4 We may remove any content at our discretion.
5.5 Do not upload images or details of any child, or of anyone without their consent. We review fundraiser content before it is public and remove unlawful content. We act within 24 hours on any complaint about intimate or child-identifying images (see the Grievance Redressal Policy).
6. Our content
6.1 The Site's text, design, logo and software belong to Saath Foundation or our licensors. You may share links and quote short passages with credit. You may not reuse our logo or imply our endorsement without written permission.
6.2 Images of children. Every image of a child on the Site is either (a) a real photo used with documented guardian consent, or (b) an illustration or AI-generated image, labelled as an illustration. Illustrations never show a real child.
6.3 Children's stories are shared with consent, with names and details changed where marked. Sample stories are labelled as samples.
7. Figures and information
We work to keep every figure accurate and dated. Funding bars update as confirmed payments arrive. A pending wire transfer is never shown as confirmed. Figures may be provisional until our accounts are audited. General information on the Site, including tax guides, is not professional advice.
8. Links and third-party services
Payments are handled by Razorpay on its own pages. Links to other sites are for convenience. We are not responsible for their content or practices.
9. Availability
We aim to keep the Site available but may pause it for maintenance, security or reasons outside our control. We are not liable for loss caused by unavailability, except where the law does not allow us to exclude it.
10. Liability
10.1 Nothing in these terms limits liability that cannot be limited under Indian law, including for fraud or for death or personal injury caused by negligence.
10.2 Otherwise, Saath Foundation is a charity. To the extent the law allows, our total liability to you for any claim about the Site is limited to the amount you paid to Saath Foundation in the 12 months before the claim, and we are not liable for indirect or consequential loss. This does not limit any right you have under data-protection or consumer law.
11. Indemnity
If you breach these terms and a third party makes a claim against Saath Foundation as a result, you agree to cover Saath Foundation's reasonable losses and costs, to the extent the law allows.
12. Changes
We may update these terms. The version and date at the top will change. For changes that materially affect registered users, we will give at least 15 days' notice by email or in your account.
13. Law and disputes
13.1 These terms are governed by the laws of India.
13.2 We encourage you to raise any complaint first through the Grievance Redressal Policy.
13.3 Subject to any right you have to approach a consumer commission or the Data Protection Board of India, the courts at Delhi have exclusive jurisdiction.
